What is Alternative Dispute Resolution (ADR)?
ADR are mechanisms for resolving disputes between people and companies which avoid the litigation process, or at least traditional trial by a judge or by judge and jury.
Forms of ADR include Mediation (negotiations assisted by a neutral third-party), Arbitration (essentially, a private trial where the parties choose both the judge and the rules that will apply to the trial), and Mediation-Arbitration (a combination of both processes).
Why ADR.?
ADR. can assist people in conflict by reducing time, cost and, often, uncertainty. As well, for many lawsuits, the Court requires that a Mediation session take place at some point before trial.
